All emergency crews responded including Toole County Search and Rescue who diverted traffic into Shelby. I-15 North was reopened at 9:30 PM at the wreck site and traffic at Shelby was still being diverted into Shelby. It shall be the duty of the owner of any premises within the limits of the municipality to keep the sidewalk of and abutting his premises clear of more than one inch (1") of snow, any amount of snowpack, any amount of ice, any amount of slush, any amount of mud, and all other threats to safe foot travel and to prevent the accumulation of same.&lt;br /&gt;&lt;br /&gt;B. A property owner shall have twenty four (24) hours after a snowstorm ends to clear the sidewalk of snow greater in depth than one inch (1").&lt;br /&gt;&lt;br /&gt;C. A property owner shall have twenty four (24) hours after snowpack, ice, slush, mud, or other threats to safe foot travel accumulate to remove the snowpack, ice, slush, mud, or threat.&lt;br /&gt;&lt;br /&gt;D. In the event that snow or ice cannot be reasonably removed due to possible damage to the sidewalk or it is otherwise largely impractical to remove, the owner shall put on the sidewalk sand or other abrasive material in such an amount and manner to make foot traffic reasonably safe. The owner shall maintain that condition until weather permits the removal of the snow or ice. (Ord. 794, 3-16-2009)&lt;br /&gt;9-4-2: FAILURE TO COMPLY:&lt;br /&gt;&lt;br /&gt;Upon the failure of the owner of any premises to keep the sidewalk abutting his property in compliance with section 9-4-1 of this chapter, the city of Shelby shall have the right to remove such snow, snowpack, ice, slush, mud, and other threats to safe foot travel and assess the cost thereof against the property abutting the sidewalk. (Ord. 794, 3-16-2009)&lt;br /&gt;9-4-3: NO NOTICE REQUIRED:&lt;br /&gt;&lt;br /&gt;The city of Shelby is not required to provide any notice to the owner of the premises abutting a sidewalk before it exercises its rights under section 9-4-2 of this chapter. (Ord. 794, 3-16-2009)&lt;br /&gt;9-4-4: PENALTY:&lt;br /&gt;&lt;br /&gt;Any owner of any premises within the limits of the municipality who violates any provision of this chapter is guilty of a misdemeanor and, upon conviction thereof, shall be fined in an amount not exceeding twenty five dollars ($25.00) or be imprisoned in the county jail for a period not exceeding two (2) days, or be both so fined and imprisoned. Each day such violation is committed or permitted to continue constitutes a separate offense and shall be punishable as such hereunder. (Ord. 796, 5-18-2009)&lt;br /&gt;&lt;br /&gt;Here is the one that does not mention the fines and jail time...&lt;br /&gt;&lt;br /&gt;ORDINANCE NO. 794&lt;br /&gt;&lt;br /&gt;AN ORDINANCE AMENDING TITLE 9, CHAPTER .04.&lt;br /&gt;&lt;br /&gt;OF THE SHELBY MUNICIPAL CODE&lt;br /&gt;&lt;br /&gt;BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF SHELBY, MONTANA:&lt;br /&gt;&lt;br /&gt;THAT Title 9, Chapter .04 Removal of Snow and Ice, as found in the Shelby Municipal Code is Amended to read as follows:&lt;br /&gt;&lt;br /&gt;9-4-1  KEEPING SIDEWALKS CLEAR:&lt;br /&gt;&lt;br /&gt;A. Memorial services will be 2:00 pm Friday, November 4, at the Whitted Funeral Chapel in Shelby.&lt;br /&gt;&lt;br /&gt;Survivors include her husband of 17 years, Bob McPherson of Big Timber; mother, Darlene Alvestad of Shelby; sisters, Connie (Ron) Iverson of Ledger, MT, Vicki (Denny) Knickerbocker, and Kathy Huso Alvestad both of Shelby, MT; a brother, Dave (Barbie) Alvestad of Shelby, MT; step-children, Scott (Rita) of Glendive, MT Steve (Amber) of Salt Lake City, Shane (Amber) of Glendive, MT and Garth of Riverton, WY; 9 grandchildren and 1 great-grandchild; as well as numerous nieces and nephews.&lt;br /&gt;&lt;br /&gt;She is preceded in death by her beloved father, Tony Alvestad in 1975.&lt;br /&gt;&lt;br /&gt;Lori was born December 20, 1955 to Tony and Darlene (Fisk) Alvestad at Shelby where she was raised and graduated from high school in 1974. She attended the University of Montana majoring in French. She was selected to live in Dijon, France for several months as part of her studies; an experience she truly loved and spoke of often.&lt;br /&gt;&lt;br /&gt;Lori loved to entertain and sing. She sang with the Lost Highway Band and the Electric City Jazz Band. Lori always impressed everyone with her beautiful voice. Lori’s most notable music accomplishment was an appearance as the opening act for the legendary BB King at a concert in Missoula.&lt;br /&gt;&lt;br /&gt;Her life accomplishments include graduating in the top ten of her class from high school and her lifelong love for her pets, Charlie, Shoogie and Buddy. She also starred in several Montana Theatrical Productions including Hello Dolly, Godspell and Fiddler on the Roof along with many others. She also sang at many events including her nieces’ and nephews’ weddings.&lt;br /&gt;&lt;br /&gt;On February 12, 1994, she married Bob McPherson and after several years of living in Montana and Idaho they settled near Big Timber where they lived in a cabin on the Boulder River. Approximately 38 school age students and two adults were injured.&lt;br /&gt;&lt;br /&gt;U.S. Highway 2, at mile marker 296 about 16 miles east of Shelby, was closed for approximately four hours to clean up the wreckage.&lt;br /&gt;&lt;br /&gt;At approximately 2:45 p.m., the bus, driven by Felicianao Holguin, 39, negotiated a gradual left curve on the highway. As the bus was coming out of the curve, it went off the south side of the highway. Holguin steered the bus back onto the highway, which caused the bus to venture into the oncoming traffic lane. Holguin counter steered the bus back into the right lane, which caused the bus to spin in a clockwise rotation. Once the bus was sideways on the highway, it tipped over onto the driver’s side and skidded on the highway until it came to rest. The bus blocked both lanes of traffic on U.S. Highway 2. Holguin said a heavy gust of wind caused the bus to initially be pushed over to the side.&lt;br /&gt;&lt;br /&gt;A “code red” blanket was declared, which notified responders of a potential mass casualty event. Along with Montana Highway Patrol, emergency units from four counties (Toole, Pondera, Glacier and Liberty), United States Border Patrol, Customs and Border Protection, Motor Carrier Services, Montana Department of Transportation and Toole County Health Department all came together to assist. Mercy Flight responded with a helicopter and a fixed wing aircraft.&lt;br /&gt;&lt;br /&gt;Injured patrons were transported to Marias Medical Center in Shelby, Pondera County Medical Center in Conrad, Northern Rockies Medical Center in Cut Bank, Liberty County Medical Center in Chester and Benefis Hospital in Great Falls. Most of the people injured in the crash were treated and released for minor injuries, but three remained hospitalized at Benefis in Great Falls.&lt;br /&gt;&lt;br /&gt;The bus passengers had just spent the week at Glacier Bible Camp at an annual Indian Youth Camp. Most ranged from grade school age to high school age. Camp counselor Malachy Hornung, reporting from Benefis, said the three injured passengers who remain hospitalized are “doing very well.”&lt;br /&gt;&lt;br /&gt;&lt;object width="400" Crews now have about one more day of work left. The bridge was struck by a truck carrying a crane as it passed underneath. Don is from Calgary, Alberta and was on his way to meet friends to go riding at the Bear Tooth Pass. After a nice visit we took the photos of him with his pride and joy... One of the very large tanks that the truck was hauling dislodged and the other was squeezed into place under the bridge. Police and Highway Patrol plus a National Transportation Safety officer responded. Many years ago, mostly starting in the '80s , the City of Shelby started a rigorous campaign to replace and improve upon its potable water, sanitary sewer and storm sewer systems. Now comes a time to replace an aging sewer that is leaking, not out but in, that's right, the sewer is taking on ground water at a huge rate. Some years ago,  the tanks, buildings and equipment was removed. Next it was assessed as to how much earth and that below ground needed to be removed due to contamination. Just in the last year and a half, all contaminated earth and other material has been abated. The cost will be $35.00 a year or approx. $2.92 a month. Readers will also have to log-in each time with a username and password. We checked out the new online edition and found that it is a photo copy in .PDF format. It is not too hard to read if you have normal close to 20/20 vision but may be hard for someone with limited eyesight. We at NBMC purposely format our sites with larger print plus readers can use the zoom text only feature on their browser. Also, maybe it was because the computer was already handling several tasks but one of our computers crashed will viewing the Shelby Promoter's new site. It was a good excuse to get another cup of coffee while that computer resurfaced. By-the-way, NBMC is still free and open after eight years.&lt;br /&gt;&lt;br /&gt;Shelby Promotor:&lt;br /&gt;"Many of the most popular features are still on the newly-designed website, including weekly news, sports, feature stories and photos and obituaries. You must have heard about that date being a supposed end of the world or some other big event. Come on, there are two major movies out that try to depict what may happen. Plus, here are some others trying to convince humanity. Journalist Lawrence Joseph forecasts widespread catastrophe in Apocalypse 2012: A Scientific Investigation Into Civilization’s End. Spiritual healer Andrew Smith predicts a restoration of a “true balance between Divine Feminine and Masculine” in The Revolution of 2012: Vol. 1, The Preparation. In 2012, Daniel Pinchbeck anticipates a “change in the nature of consciousness,” assisted by indigenous insights and psychedelic drug use. However, there are also leading scientists that are also trying to get the word out that it is very unlikely that anything like that is to happen. The buildup to 2012 echoes excitement and fear expressed on the eve of the new millennium, popularly known as Y2K, though on a smaller scale, says Lynn Garrett, senior religion editor at Publishers Weekly. She says publishers seem to be courting readers who believe humanity is creating its own ecological disasters and desperately needs ancient indigenous wisdom. "Maya civilization, known for advanced writing, mathematics and astronomy, flourished for centuries in Mesoamerica, especially between A.D. 300 and 900. The boy could not stop in time and ran into the side of the trailer. When NBMC arrived, the boy was sitting up and talking to the ambulance crew. He had one leg bandaged and was being loaded onto a stretcher. The cannon, fashioned from large oilfield pipe has been fired at various events over the past years. According to unofficial report, this year, the owner(s) thought they would spice things up a bit. In order to do that, they added a double charge of powder before inserting the customary watermelon. The cannon was located in the middle of the Main Street business district and next to the Tap Room bar. As you might expect, all hell broke loose when the cannon was lit. It blew all to pieces sending chunks of steel hurling everywhere. One chunk blasted trough the Tap Room bar's front window not stopping until it hit the back wall in the building. The bar was full of people at the time and luckily the only injuries were minor cuts from the flying glass. Two other pieces of steel made about 8 inch holes through a glass door and window of the USbank building. One hit the ATM machine and the other the bank vault. The bank was closed with no persons inside. Some car windows were knocked out, a business's airconditioner was destroyed, a large awning had a long cut in it and business alarms went off. The life-size figure stands as a busty beacon outside a restaurant in suburban Reading (REH'-ding) owned by Kenny Tessel. He told zoning officials at a hearing Wednesday night that the advertising gimmick has boosted business 40 percent. The 5-foot-10 mannequin is on the street wearing a bikini top and tight short-shorts, though Tessel brought her to the hearing draped in a long, sleeveless gray T-shirt. The board said Tessel may continue to use the figure only if it's dressed more modestly in front of the restaurant, too. But does it really bring about that benefit or does it just increase the blood pressure of in town property owners? The basics of the new ordinance are as follows: The ordinance gives property owners a maximum of 24 hours after a snowstorm ends to clear the sidewalk abutting the property and used by the public of snow greater in depth than one inch. Property owners also have a maximum of 24 hours to remove any snow pack,  any ice, any slush, any mud and any other threat to safe foot travel. If, for some reason, the snow and or ice cannot be reasonably removed, the owner must apply sand or other abrasive material to the sidewalk to make foot travel reasonably safe and repeat as needed. Failure to comply will give the City of Shelby the right to remove such threats to safe foot travel and assess the cost against the property. This ordinance also states that no notice to the owner of the premises is required. This is a paraphrased reading of the full ordinance. This ordinance all sounds fine and good until you look closer and give it more thought. First, who is to decide if the snow or ice can or cannot be reasonably removed? How much sand or "other" abrasive is needed? Also, for the many walkway areas all over town that have no concrete and are just dirt or grass covered, removal of "any mud" as stated in the ordinance is impossible. Then the biggest issue is the streets. When someone is out walking, they almost always have to cross a street. The city is not placing the same need for safety there. Sure, the city has been making an effort to clear some snow from the streets but this past winter many streets had near to a foot of heavy packed snow and ice. Not all streets were ever cleared or sanded. Also, the city did put out some sand at busy intersections and up some streets, but the main basis for that is to help vehicle tire footing not pedestrian. Some sand under human foot can actually be like walking on kids marbles and cause one to slip and fall. Beyond the practical or in this case, the impractical, implementation of this ordinance is the headache and financial burden placed on the common property owner. If the city has as much trouble clearing the streets and alleys because of practical and financial reasons, how will it be for the property owners who are now expected to hold to a much, much higher level with their sidewalks??? Alaska's largest city has not yet seen falling ash, though some fine gray dust was falling Monday morning on some communities north of Anchorage. The ash began falling around daybreak and continued into the middle of morning. Alaska Airlines on Monday canceled 19 flights in and out of the Anchorage international airport because of the ash. The "ash" is actually super fine volcanic rock dust and is a very abrasive substance which can damage jet engines and even clog their function. The dust is also a big hazard to vehicles and extremely dangerous for animals and humans. Scientists have been watching Mount Redoubt all along knowing that even though its last eruption was nearly twenty years ago the volcano was set for more. The truck containing the pipes was coming in from Canada and was picked out to be one randomly searched. A news release said the pipes were worth more than $284,000 and that documents showed that they were on the way to California, Texas and Florida. During the search it was determined that the shipment had suspicious paperwork. Customs and Border agencies said the seized shipment had a number of problems, including false invoicing, false marking, false names for the shipper and consignee, as well as being undervalued.
